Including Health Declaration, Serious Illness Reminder, Class Suspension and Safe Practice Principles

This Agreement is an important confirmation document regarding self-directed health management and safe practice for Participants of Bai Yin Qigong before participating in courses, group practice sessions, review sessions, practice assessments, assisted practice sessions, lectures, activities, and online learning services.

By selecting “I Agree”, submitting the form, completing registration, logging into the course platform, or actually participating in any course, I acknowledge that I have read, understood, and agreed to the contents of this Agreement.

For the purposes of this Agreement, “Bai Yin Qigong” or “the Organisation” refers to the Bai Yin Qigong brand, the organising entity actually providing the courses or receiving payment, authorised Instructors, authorised administrative teams, and cooperating entities legally or contractually entrusted to provide course services. The actual service provider shall be subject to the information stated on the local registration page, receiving entity, or course announcement.

1. Purpose of this Declaration

I understand that Bai Yin Qigong is a learning system for health preservation, health promotion, physical and mental relaxation, and self-directed health management. It is not a medical service, medical diagnosis, disease treatment, rehabilitation therapy, psychotherapy, or disease cure service.

I understand that the emphasis of qigong practice is on safety, stability, relaxation, gradual progression, and continuous practice. Every individual’s age, constitution, medical history, physical fitness, lifestyle, medication use, psychological condition, and physical responses are different. Therefore, I am responsible for monitoring my own physical condition and practising within my own limits during every course, group practice, review session, practice assessments, assisted practice sessions, or activity.

The purposes of this Agreement are:

1. To help me understand the health and safety matters that require attention before participating in qigong practice.

2. To assist the Instructor, where necessary, in understanding my health condition in order to provide appropriate safety reminders and course guidance.

3. To confirm that I understand under what circumstances I should stop practising, suspend classes, or seek medical attention as a priority.

4. To clearly inform me that qigong practice must not replace conventional medical care, medication, surgery, rehabilitation, or a physician’s advice.

2. Responsibility for Self-Directed Health

I agree that:

1. When participating in any training, course, group practice, review session, practice assessments, assisted practice sessions, or group activity, I will independently assess my own physical fitness and health condition.

2. I will not force myself, overexert myself, compare myself with others, pursue excessive qi sensations, or pursue intense physical reactions.

3. During practice, comfort, relaxation, and stability shall be my basic principles, and I should not experience fatigue, excessive sweating, rapid heartbeat, dizziness, or chest discomfort.

4. If I am not in good physical condition, I will proactively reduce the intensity, change to higher-position movements, reduce repetitions, rest, or suspend practice.

5. If I have an illness, am recovering from surgery, am pregnant, have a special physical condition, significant medical history, am taking medication, or undergoing treatment, I will give priority to the advice of a qualified physician or healthcare professional.

6. If I am uncertain whether I am suitable to participate in the course, I should consult a physician before registration or before attending class, and decide whether to participate according to the physician’s advice.

7. If my health condition changes after registration or during the course period, I shall proactively inform Bai Yin Qigong, the authorised Instructor, or administrative personnel.

8. If I fail to truthfully disclose my health condition, or continue to participate when I am not suitable for practice, I shall bear the corresponding risks and consequences arising therefrom. However, this provision does not exclude or limit any liability that cannot legally be excluded or restricted.

3. Situations Requiring Immediate Cessation of Practice

I understand that if any of the following conditions occur during practice, I should stop practising immediately and, where necessary, seek prompt medical attention or emergency assistance:

1. Chest pain, chest tightness, or unexplained pressure in the chest.

2. Palpitations, angina, or obvious abnormal heartbeat.

3. Difficulty breathing, shortness of breath, or inability to breathe properly.

4. Dizziness, vertigo, blacking out, near fainting, or breaking out in a cold sweat.

5. Unexplained pain, sprains, abdominal pain, or severe headache.

6. Nausea, vomiting, weakness of the limbs, or loss of bodily control.

7. Numbness of the hands or feet, weakness on one side of the body, slurred speech, abnormal vision, or other suspected neurological symptoms.

8. Hypoglycemia, trembling, cold sweats, confusion, or other diabetes-related warning signs.

9. Any physical reaction that I consider unusual, uncomfortable, unsafe, or beyond my tolerance.

I understand that if an emergency occurs during practice, medical treatment shall take priority. I should not continue practising, endure the symptoms while observing them, or wait until the course has ended.

4. Situations in Which Attendance Is Unsuitable or Practice Should Be Suspended Immediately

I understand that if any of the following situations arise, I should first suspend classes or practice and give priority to medical care, rest, or my physician’s advice:

1. Fever, acute infection, severe cold, or obvious physical weakness.

2. Chest pain, chest tightness, difficulty breathing, obvious palpitations, or extremely unstable blood pressure.

3. Having recently undergone major surgery with less than one month of recovery, or where wounds, bones, joints, or muscles remain significantly painful.

4. During the acute stage of cancer treatment, while undergoing chemotherapy or radiotherapy, with obvious physical weakness, low blood cell counts, or during any period when a physician advises suspension of exercise.

5. Diabetes with hypoglycemia, extremely unstable blood glucose control, frequent dizziness, cold sweats, or confusion.

6. Severe fluctuations in mental or emotional state, obvious anxiety or panic, being highly suggestible, or inability to consistently follow course instructions.

7. Where a physician has explicitly advised suspension of exercise, avoidance of specific movements, or restriction of physical activity.

8. When I feel unsafe, uncomfortable, physically unable to continue practice, or unable to clearly assess my own condition.

9. Where the venue, environment, equipment, internet connection, or accompanying care arrangements are inadequate and may affect safe practice.

10. Where the Instructor or staff, based on safety considerations, recommends suspension of practice, lower-intensity practice, or seeking medical attention first.

5. Disclosure of Serious Illnesses and Special Conditions

I understand that the following health information constitutes relatively sensitive personal data. Bai Yin Qigong will collect, process, and use such information only to the extent necessary for course safety, Participant care, emergency contact, risk management, and essential administrative operations, and will safeguard it in accordance with the applicable personal data protection laws.

I understand that if I currently have, or have previously had, any of the following conditions, I should proactively inform Bai Yin Qigong, the authorised Instructor, or administrative personnel before registration or attendance, and where necessary obtain my physician’s approval before participating in the course. If I am uncertain whether disclosure is required, I should disclose the information as a matter of principle.

5.1 Cardiovascular Conditions

Chest tightness, chest pain, unexplained chest discomfort, myocardial infarction, cardiac catheterisation, cardiac pacemaker, angina pectoris, myocardial hypertrophy, endocarditis, rheumatic heart disease, congenital heart disease, aortic aneurysm, family history of heart disease, unstable hypertension, severe arrhythmia, or other cardiovascular diseases.

5.2 Brain and Nervous System

Stroke, cerebral haemorrhage, cerebral infarction, brain tumour, cerebral aneurysm, cerebral arteriosclerosis, epilepsy, Parkinson’s disease, unexplained vertigo, dizziness, previous fainting episodes, limb weakness, or other neurological disorders.

5.3 Serious Illnesses and Chronic Diseases

Cancer, advanced malignant tumours, organ transplantation, liver cirrhosis, uremia, hemophilia, leukemia, autoimmune diseases, diabetes, kidney disease, severe anaemia, diseases requiring long-term medication, or illnesses for which a physician has specifically required restriction of exercise.

5.4 Respiratory System

Unexplained breathing difficulty, emphysema, bronchiectasis, tuberculosis, pulmonary embolism, severe asthma, chronic obstructive pulmonary disease, or other respiratory diseases.

5.5 Bones, Joints, Spine, and Postoperative Conditions

Failure to recover from major surgery, less than one month after surgery, artificial joints, severe osteoporosis, spondylolisthesis, acute herniated disc, fracture recovery, recovery following joint replacement surgery, or skeletal and joint conditions for which a physician has recommended activity restrictions.

5.6 Other Special Conditions

Pregnancy, postpartum recovery, history of mental illness, markedly unstable emotional condition, retinal detachment, pancreatitis, severe infection, fever, weakened immune function, severe physical or psychological discomfort resulting from practising other qigong systems or learning methods, and any other condition that I believe may affect safe practice.

6. Safe Practice Principles for Serious Illnesses and Special Physical Conditions

I understand that if I have a serious illness or special physical condition, I should adopt a more conservative approach to practice. The following principles are safety reminders only and do not constitute medical advice or a treatment plan.

6.1 Individuals with Cardiovascular Disease or Unstable Blood Pressure

Do not perform forceful movements, do not hold your breath, do not practice reverse abdominal breathing, and do not perform rapid up-and-down or excessively strenuous movements. If chest pain, chest tightness, difficulty breathing, obvious palpitations, or abnormal blood pressure occur, stop immediately and seek medical attention.

6.2 Individuals with Brain Disorders, Neurological Conditions, or a History of Fainting

Avoid rapid turning, walking with eyes closed, prolonged bending of the head, standing up suddenly, excessive vibration, or movements that may cause dizziness or loss of balance. If dizziness, blacking out, limb weakness, slurred speech, or visual abnormalities occur, stop immediately and seek medical attention.

6.3 Individuals with Unstable Mental Conditions

Practice relaxed, stable, simple, and controllable movements. Do not pursue strong qi sensations, special experiences, deep meditative states, or intense physical or psychological reactions. If emotional fluctuations, panic, worsening insomnia, or anxiety occur after practice, suspend practice and seek professional assistance.

6.4 Individuals Recovering from Surgery

Adjust practice according to the surgical site, recovery stage, and physician’s advice. Where necessary, perform only gentle movements, avoiding strain on the wound, excessive core exertion, twisting, compression, excessive stretching, or any movement that causes pain.

6.5 Individuals with Cancer or Chronic Diseases

During stable periods, low-intensity, short-duration, gentle practice may be performed according to physical capacity. During the acute stage, unstable treatment period, low blood cell counts, high infection risk, extreme physical weakness, or when a physician advises against exercise, practice should first be suspended.

6.6 Individuals with Diabetes

Avoid practising on an empty stomach. It is recommended to practice approximately 1 to 1.5 hours after a meal, while paying attention to signs of hypoglycemia. If cold sweats, trembling, palpitations, dizziness, weakness, or confusion occur, stop immediately and follow medical advice.

6.7 Individuals Using Special Medical Devices, Cardiac Devices, or Long-Term Medication

Avoid rapid turning, walking with eyes closed, strong pressure on the chest, prolonged breath-holding, excessive exertion, or movements that may affect the safety of the device. Where necessary, consult a physician beforehand regarding suitability for participation.

6.8 Individuals Who Are Pregnant, Postpartum, or Have Special Gynecological Conditions

Consult a physician first. Avoid compressing the abdomen, excessive twisting, breath-holding, forceful squatting, prolonged standing, or movements that cause abdominal discomfort. If bleeding, abdominal pain, uterine contractions, dizziness, or other abnormalities occur, stop immediately and seek medical attention.

6.9 Individuals with Retinal Detachment or Special Eye Disorders

Avoid excessive bending of the head, breath-holding, strong vibration, rapid shaking, or movements that may increase eye pressure. If visual abnormalities, dark spots, flashes of light, or eye discomfort occur, stop immediately and seek medical attention.

6.10 Older Adults, Individuals with Physical Weakness, or Those Who Have Not Exercised for a Long Time

Begin with low-intensity, short-duration, high-position movements. Avoid practising for excessive durations, excessive volume, or pursuing perspiration. If significant fatigue occurs after practice, reduce the amount of practice, rest, and report the condition to the Instructor.

7. Medical Priority and Medication Principles

I have been clearly informed that:

1. Bai Yin Qigong is a health preservation and health promotion course, and is not a medical practice.

2. If I have any illness, physical discomfort, or health concerns, I should consult a physician first and receive diagnosis, treatment, and follow-up from a qualified physician or healthcare professional.

3. I must not discontinue medication, reduce medication, interrupt treatment, delay medical consultation, or refuse medical care on my own because of practising qigong, feeling improvement, hearing the experiences of others, viewing Participant testimonials, participating in courses, or receiving reminders from an Instructor.

4. Any decisions regarding medication, surgery, treatment, rehabilitation, psychotherapy, or other medical care shall be based on the assessment of a qualified physician or healthcare professional.

5. Any sharing by an Instructor, staff member, or other Participant shall not be regarded as medical advice or a substitute for a physician’s diagnosis.

8. General Principles for Safe Practice

I agree to observe the following principles during every practice session:

1. Stabilise first, then practice. Consult the physician first, then the Instructor.

2. Do not pursue strong qi sensations or force the body into special states.

3. Do not over-practice, or independently increase the amount, speed, intensity, or duration of practice.

4. Do not imitate movements that I have not yet learned, have not been confirmed by an Instructor, or are unsuitable for my condition.

5. Do not independently combine other qigong systems, breathing methods, meditation methods, exercise methods, or online instructional content, in order to avoid increasing physical burden or making self-assessment more difficult.

6. If obvious fatigue, discomfort, rapid heartbeat, dizziness, insomnia, emotional fluctuations, or other adverse reactions occur after practice, I should first reduce the amount of practice, rest, and report the condition to the Instructor.

7. During online practice, I should personally ensure that the practice area is safe, the floor is stable, there is sufficient space, and the lighting and ventilation are adequate. Where necessary, I should practice with a family member present or in a safe environment.

8. During in-person classes or outdoor group practice sessions, I should follow the instructions of the on-site Instructor and staff, while paying attention to weather conditions, ground conditions, traffic, personal belongings, and my own safety.

9. The highest principle of practice is comfort, relaxation, stability, vitality, and never forcing myself.

9. Collection, Use, and Protection of Health Information

I understand that, as necessary for course safety, health reminders, and Participant care, Bai Yin Qigong may collect, process, and use the health-related information that I provide.

9.1 Purpose of Collection

The health-related information I provide shall be used only for the following purposes:

1. To determine whether I require safety reminders, reduced practice intensity, or suspension of practice.

2. To assist the Instructor in providing appropriate practice reminders during the course.

3. Participant care, administrative communication, course arrangements, and necessary notifications.

4. Emergency response and emergency contact.

5. Dispute resolution, legal compliance, and necessary internal records.

9.2 Scope of Use and Authorised Personnel

My information shall be accessible only to personnel with a legitimate need to know, including Master Bai Yin, Master Yin Quan, authorised Instructors, authorised administrative personnel, course service personnel, and cooperating service providers who are legally or contractually bound by confidentiality obligations.

Without my consent, my information will not be disclosed, sold, or provided to unrelated third parties, except where otherwise required by law, for emergency rescue, to protect my life or the life and physical safety of others, or where necessary for the provision of course services.

9.3 Cross-Regional Processing

As Participants, Instructors, administrative personnel, and system service providers of Bai Yin Qigong may be located in Taiwan, Malaysia, Singapore, Hong Kong, or other regions, I understand and agree that my health-related information may be processed or accessed across regions to the extent necessary for course services, system storage, administrative management, emergency contact, and legal compliance.

Bai Yin Qigong will take reasonable measures to require relevant personnel and cooperating entities to maintain the security and confidentiality of the information.

9.4 Access, Correction, Suspension of Use, and Withdrawal of Consent

Subject to applicable law, I may apply to Bai Yin Qigong to inquire about, access, correct, supplement, suspend the use of, or delete my information, or withdraw my consent to the extent permitted by law.

If I withdraw my consent for the use of essential health information or emergency contact information, it may affect Bai Yin Qigong’s ability to provide course safety reminders, Participant care, emergency response, or related services.

9.5 Personal Data Contact Point

If I wish to inquire about, access, correct, supplement, suspend the use of, or delete my health-related information, or withdraw part or all of my consent, I may submit a request through Bai Yin Qigong’s official customer service, the course administrative office, or the contact method designated by the Organisation. The Organisation will process the request in accordance with applicable laws and within a reasonable processing period.

9.6 Retention Period

My health-related information will be retained for the period necessary to fulfil the purposes for which it was collected. If retention is required for membership service records, legal compliance, accounting, taxation, dispute resolution, administrative management, or safety records, it will be retained for a reasonable period or as required by law.

Upon expiration of the retention period, or when retention is no longer necessary, the information will be deleted, destroyed, anonymised, or de-identified.

10. Bai Yin Qigong’s Authority for Safety Management

I understand that Bai Yin Qigong, authorised Instructors, or on-site staff may, based on safety, course order, or risk management considerations, take the following measures as appropriate:

1. Recommend that I reduce the intensity of practice, change to higher-position movements, suspend specific movements, or temporarily suspend practice.

2. Recommend that I seek medical attention first or obtain a physician’s approval before resuming classes.

3. Suspend my participation in the current course, group practice session, or activity if my physical condition is clearly unsuitable for participation.

4. In an emergency, assist in notifying my emergency contact, calling an ambulance, or taking other reasonable emergency assistance measures.

5. If I fail to truthfully disclose significant health risks or refuse to comply with necessary safety reminders, Bai Yin Qigong may suspend or terminate my participation in relevant courses or activities according to the circumstances.

The above measures are taken for course safety and risk management and do not mean that Bai Yin Qigong or its Instructors assume responsibility for medical diagnosis or treatment.

11. Authorisation for Emergency Response and Contact

I understand that if I experience obvious physical discomfort, loss of consciousness, a fall, chest pain, difficulty breathing, or any other emergency during any course, group practice session, review session, practice assessments, assisted practice sessions, lecture, activity, or online learning session, Bai Yin Qigong, authorised Instructors, staff, or on-site personnel may, for the purpose of protecting my life and physical safety, take reasonable emergency assistance measures, including but not limited to:

1. Assisting me in suspending practice, resting, or leaving the venue.

2. Notifying my designated emergency contact.

3. Assisting in calling the local emergency medical service or an ambulance.

4. Providing healthcare or emergency personnel, within the necessary scope, with the health information that I have disclosed.

5. Taking any other reasonable safety measures appropriate to the circumstances.

I understand that the above emergency assistance measures are provided for safety and humanitarian purposes and do not mean that Bai Yin Qigong, the Masters, Instructors, or staff assume responsibility for medical diagnosis, treatment, or care.

12. Participation by Minors

This course is, in principle, intended for registration and participation by adults. If a Participant has not reached the age of majority as prescribed by applicable local law, prior approval from Bai Yin Qigong must be obtained, and the Participant’s legal representative or guardian must carefully read and agree to this Agreement before the Participant may register for and participate in the course.

Upon providing consent, the legal representative or guardian shall assist the Participant in understanding the nature of the course, responsibilities for personal health, safe practice principles, the use of personal data, emergency procedures, and other relevant course regulations.

13. Confirmation of Self-Directed Health Management

I confirm that:

1. I have carefully read and understood this Bai Yin Qigong Self-Directed Health and Safe Practice Agreement.

2. I understand that Bai Yin Qigong is a health preservation and health promotion course and is not a medical diagnosis, treatment, rehabilitation, or disease cure service.

3. I agree that, when participating in any course, group practice session, review session, practice assessments, assisted practice sessions, or activity, I will independently manage my health condition, practice within my own limits, and, where necessary, stop immediately and seek medical attention.

4. I agree to truthfully provide health information relevant to course safety and to proactively notify Bai Yin Qigong if my health condition changes.

5. I understand that refusing to provide necessary health information, refusing to sign this Agreement, or withdrawing consent for the use of necessary information may result in my being unable to participate in part or all of the courses, group practice sessions, review sessions, or activities.

6. I understand that completion of this Agreement is required before I may participate in Bai Yin Qigong courses, group practice sessions, and activities.

14. Signature Constitutes Agreement to the Following

By attending the class, I am deemed to have agreed to all of the following:

□ I have carefully read and agree to the Bai Yin Qigong Self-Directed Health and Safe Practice Agreement. I understand that the course is for health preservation and health promotion and is not a medical diagnosis, treatment, rehabilitation, or disease cure service.

□ I agree to truthfully disclose health conditions relevant to course safety and understand that if I have any illness, significant medical history, postoperative recovery, pregnancy, am taking medication, or undergoing treatment, I should give priority to my physician’s advice.

□ I understand that if chest pain, chest tightness, difficulty breathing, dizziness, palpitations, cold sweats, unexplained pain, one-sided weakness, slurred speech, visual abnormalities, or any other discomfort occurs during practice, I should stop practising immediately and seek medical attention where necessary.

□ I agree that Bai Yin Qigong may collect, process, and use the health-related information I provide to the extent necessary for course safety, Participant care, emergency contact, administrative communication, and legal compliance.

□ I understand that in the event of an emergency, Bai Yin Qigong, authorised Instructors, or staff may, for the purpose of protecting my life and physical safety, assist in notifying my emergency contact, calling the local emergency medical service, and, within the necessary scope, providing the health information I have disclosed to healthcare or emergency personnel.
